Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Ingat SMS Scam Detector application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User", "you") and the Ingat Development Team ("Ingat", "we", "us", "our").

2. Description of Service

Ingat is an AI-powered SMS scam detection application designed for Filipino users. The App provides:

• Automated SMS scanning: Real-time analysis of incoming text messages to detect potential scams.
• Manual message scanning: On-demand analysis of messages pasted by the user.
• Scam analysis reports: Detailed explanations of detected threats including scam type, risk score, and reasoning.
• Community scam database: Aggregated, anonymized scam intelligence from user reports.
• SMS inbox management: Built-in messaging functionality for reading, composing, and managing SMS conversations.

3. Eligibility

• You must be at least 18 years old to use the App.
• You must have legal capacity to enter into a binding agreement under Philippine law.
• If you are installing the App on behalf of another person (e.g., a family member), you represent that you have their authorization to accept these Terms on their behalf.

4. User Account and Device Registration

Ingat automatically registers your device using a pseudonymous device identifier. This identifier is used for:

• API authentication and rate limiting
• Subscription tier management
• Service continuity across app updates

You are responsible for maintaining the security of the device on which Ingat is installed.

5. Permissions

To function properly, Ingat requires the following Android permissions:

• READ_SMS / RECEIVE_SMS: To analyze incoming SMS messages for scam detection.
• SEND_SMS: To enable the compose and reply functionality within the SMS inbox.
• READ_CONTACTS: To display contact names in the inbox and compose screen (optional).
• POST_NOTIFICATIONS: To alert you of detected threats in real-time.
• INTERNET: To communicate with our AI analysis servers for enhanced detection.

You may revoke permissions at any time through your device settings, but this may limit the App's functionality.

6. Acceptable Use

You agree NOT to:

• Reverse engineer, decompile, or disassemble the App or its AI models.
• Use the App to send spam, scam messages, or any form of unsolicited bulk messaging.
• Attempt to circumvent rate limits, authentication, or other security measures.
• Submit false scam reports to manipulate the community scam database.
• Use the App for any purpose that violates Philippine law or any applicable international law.
• Resell, sublicense, or commercially exploit the App or its analysis results without authorization.
• Interfere with or disrupt the App's servers, networks, or infrastructure.

7. Intellectual Property

All intellectual property rights in the App, including but not limited to the software, AI models, user interface design, branding, and documentation, are owned by the Ingat Development Team.

Ingat grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Disclaimers and Limitations

8.1 No Guarantee of Detection

You remain solely responsible for exercising your own judgment when responding to SMS messages. Ingat's analysis should be considered advisory, not authoritative.

8.2 As-Is Basis

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.3 Limitation of Liability

To the maximum extent permitted by Philippine law, Ingat and its developers shall not be liable for:

• Any financial loss resulting from scam messages that were not detected by the App.
• Any inconvenience caused by legitimate messages being incorrectly flagged as scams.
• Any damages arising from service interruptions, data loss, or technical failures.
• Any indirect, incidental, special, or consequential damages arising from the use or inability to use the App.

9. Subscription and Pricing

Ingat currently offers a free tier with no ads, subscriptions, or in-app purchases. If premium tiers are introduced in the future:

• Free tier functionality will remain available.
• Premium features and pricing will be clearly disclosed before purchase.
• Subscriptions will follow Google Play Store billing policies.
• You may cancel premium subscriptions at any time.

10. Community Reports

By submitting a scam report through the App, you:

• Confirm that you believe the reported message to be a scam in good faith.
• Consent to the submission of a SHA-256 hash of the sender's number (not the actual number) to our community database.
• Understand that your report contributes to aggregate scam intelligence used to protect other users.
• Agree not to submit false or malicious reports.

11. SMS Messaging

Ingat includes SMS inbox and compose functionality. When using these features:

• Standard carrier messaging rates may apply depending on your mobile plan.
• Ingat is not responsible for message delivery failures caused by your carrier or network conditions.
• You are solely responsible for the content of messages you send through the App.
• Messages are sent using your device's native SMS capabilities. Ingat does not route messages through our servers.

12. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

13. Termination

You may stop using the App at any time by uninstalling it from your device. Upon uninstallation:

• All locally stored data is deleted from your device.
• You may request server-side data deletion by emailing privacy@ingatph.com or using the in-app "Delete My Data" option.

We reserve the right to suspend or terminate access to the App if you violate these Terms, with or without notice.

14. Modifications to Terms

We may update these Terms from time to time. When material changes are made:

• The effective date will be updated.
• Users will be notified via in-app notification.
• Continued use after notification constitutes acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising from or related to these Terms shall be resolved through:

1. Good faith negotiation between the parties for a period of 30 days.
2. If unresolved, mediation administered by a mutually agreed mediator in the Philippines.
3. If mediation fails, binding arbitration under the rules of the Philippine Dispute Resolution Center, with the seat of arbitration in Metro Manila.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ingat regarding the use of the App.
